The College of Law \u2013 University of Baghdad discussed the Master\u2019s thesis entitled \u201cCivil Liability Arising from Damages Caused by the Use of Artificial Intelligence in Education: A Comparative Study,\u201d submitted by the student Fatima Waleed Dhiab, at the Private Law Department, on Sunday, July 26, 2026, in the College\u2019s Virtual Court Hall.<\/span><\/strong><\/p>\n

The examination committee consisted of:<\/span><\/strong><\/p>\n

    \n
  1. Prof. Dr. Jaleel Hassan Bshat (Chairman)<\/span><\/strong><\/li>\n
  2. Prof. Dr. Nabil Abdul Shuaibith (Member)<\/span><\/strong><\/li>\n
  3. Asst. Prof. Dr. Suad Ali Hussein (Member)<\/span><\/strong><\/li>\n
  4. Asst. Prof. Dr. Nada Abdul Kadhim Hussein (Member and Supervisor)<\/span><\/strong><\/li>\n<\/ol>\n

    The thesis aimed to explain the legal framework of civil liability arising from damages resulting from the use of artificial intelligence applications in the field of education, analyze the legal foundations upon which such liability is based, and determine the adequacy of traditional rules of civil liability in addressing emerging damages resulting from the use of artificial intelligence technologies in education.<\/span><\/strong><\/p>\n

    The thesis consisted of three chapters. The first chapter addressed the concept of artificial intelligence in education. The second chapter examined the legal nature of civil liability arising from damages caused by artificial intelligence in education, while the third chapter addressed the effects of civil liability and legal actions arising from damages caused by artificial intelligence in education.<\/span><\/strong><\/p>\n

    The thesis concluded with several recommendations, the most important of which are:<\/span><\/strong><\/p>\n

      \n
    1. Adopting rules of strict liability without fault as a legal basis for compensating damages resulting from the use of artificial intelligence systems in education, as such rules provide effective protection for injured parties without requiring proof of fault.<\/span><\/strong><\/li>\n
    2. The Iraqi legislature should enact a personal data protection law similar to those found in the comparative legislations and provide for the preservation of data processed by artificial intelligence while ensuring its protection against unauthorized use and security breaches.<\/span><\/strong><\/li>\n
    3. The responsible authorities in the Iraqi government, particularly the Ministry of Education and the Ministry of Higher Education and Scientific Research, should establish a specialized department to supervise the use of artificial intelligence in every university or school that uses such technology. Personnel assigned to this task should be selected based on their academic qualifications after successfully passing theoretical and practical examinations.<\/span><\/strong><\/li>\n<\/ol>\n
