{"id":9861,"date":"2026-07-14T12:17:13","date_gmt":"2026-07-14T12:17:13","guid":{"rendered":"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=9861"},"modified":"2026-07-14T12:17:13","modified_gmt":"2026-07-14T12:17:13","slug":"college-of-law-university-of-baghdad-discusses-a-masters-thesis-on-the-applicable-law-and-competent-court-in-artificial-intelligence-disputes","status":"publish","type":"post","link":"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=9861","title":{"rendered":"College of Law, University of Baghdad, Discusses a Master&#8217;s Thesis on the Applicable Law and Competent Court in Artificial Intelligence Disputes"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The College of Law at the University of Baghdad discussed a Master&#8217;s thesis entitled &#8220;The Applicable Law and the Competent Court in Artificial Intelligence Disputes,&#8221; submitted by Maryam Basim Qasim, a student in the Department of Private Law, on Monday, July 6, 2026, in the College&#8217;s Conference Hall.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The examination committee consisted of:<\/span><\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Asaad Fadhel Mandil \u2013 Chairman<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Assist. Prof. Dr. Mona Naeem Jaaz \u2013 Member<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Lect. Dr. Mohammed Ahmed Issa \u2013 Member<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Jaleel Hassan Bshat \u2013 Member and Supervisor<\/span><\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The thesis aimed to examine the legal rules governing the determination of the applicable law and the competent court in artificial intelligence disputes. It also assessed the extent to which traditional private international law rules are capable of addressing the unique characteristics of cross-border AI disputes, with the objective of proposing a legal framework that promotes legal certainty and provides effective protection for the parties involved.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The thesis consisted of two chapters. The first chapter examined the applicable law and the competent court in AI disputes arising from contractual liability, while the second chapter focused on the applicable law and the competent court in AI disputes arising from tort liability.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The thesis concluded with several recommendations, the most significant of which include:<\/span><\/strong><\/p>\n<ol>\n<li style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">Recommending that every smart contract concluded on a blockchain network be accompanied by a written agreement in plain natural language, set out in a parallel document specifying the applicable law and the competent court. In the event of any inconsistency between the smart contract and the written document, the provisions of the written document should prevail.<\/span><\/strong><\/li>\n<li style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">Proposing an amendment to the Judicial Organization Law to establish specialized divisions within the commercial and civil courts, to be known as &#8220;Smart Technology Disputes Divisions,&#8221; dedicated to adjudicating artificial intelligence disputes. These divisions should be assisted by technical experts capable of understanding and analyzing the programming code at issue.<\/span><\/strong><\/li>\n<li>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">Recommending the conclusion of an international convention on private international law relating to artificial intelligence to address the legislative gap in cross-border AI disputes. The proposed convention should ensure a balance between protecting injured parties and encouraging innovation by harmonizing conflict-of-law rules and rules of international jurisdiction.<\/span><\/strong><\/p>\n<\/li>\n<\/ol>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz_80974\" class=\"cz_grid_p cz_80974\"><div class=\"cz_grid cz_grid_1 clr cz_grid_c3 cz_grid_1_no_title cz_grid_1_mid tac\"><div class=\"cz_grid_item cz_grid_first\"><\/div><div class=\"cz_grid_item \"><div data-title=\"\u0645\u0646\u0627\u0642\u0634\u0629-\u0645\u0631\u064a\u06452-1200x500\"><a class=\"cz_grid_link \"
