{"id":9408,"date":"2026-03-01T17:27:29","date_gmt":"2026-03-01T17:27:29","guid":{"rendered":"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=9408"},"modified":"2026-03-01T17:27:29","modified_gmt":"2026-03-01T17:27:29","slug":"college-of-law-discusses-a-masters-thesis-on-the-role-of-public-prosecution-in-the-execution-of-criminal-penalties","status":"publish","type":"post","link":"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=9408","title":{"rendered":"College of Law Discusses a Master\u2019s Thesis on the Role of Public Prosecution in the Execution of Criminal Penalties"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text]<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The College of Law \u2013 University of Baghdad discussed a Master\u2019s thesis entitled \u201cThe Role of Public Prosecution in the Execution of Criminal Penalties\u201d by the student Mohammed Qasim Mahmoud, from the Department of Criminal Law, on Thursday, 26\/2\/2026, in the Model Court Hall at the college.<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The examination committee consisted of the following professors:<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">1.Prof. Dr. Nawal Tariq Ibrahim (Chairman)<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">2.Prof. Dr. Zain Al-Abidin Awad Kazim (Member)<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">3.Assist. Prof. Dr. Samer Saadoun Aboud (Member)<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">4.Prof. Dr. Sabah Sami Dawood (Member and Supervisor)<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The thesis aimed to highlight the role of the public prosecution during the stage of executing criminal penalties by focusing on the legal mechanisms granted to it by the legislator and identifying the positive and negative aspects within the provisions of the current Public Prosecution Law.<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The thesis consisted of three chapters:<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The first chapter discussed the conceptual framework of the Public Prosecution institution.<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The second chapter examined the role of the Public Prosecution in supervising criminal procedures.<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The third chapter addressed the supervision of the Public Prosecution over issues related to the execution of criminal penalties.<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">The thesis concluded with several recommendations, the most important of which were:<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">1.Removing the term \u201cestablishes\u201d from Article (1) of the current Public Prosecution Law No. 49 of 2017 and replacing it with the term \u201corganizes the Public Prosecution institution.\u201d<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">2.The Iraqi legislator should enact a special law on the execution of criminal penalties and grant the judge responsible for executing criminal penalties broad powers and duties in order to achieve the purposes of punishment in reform and social rehabilitation.<\/span><\/h3>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\">3.Including the Public Prosecution within Article (271) of the Criminal Procedure Law No. 23 of 1971 among the parties entitled to request a retrial, since it represents the public interest.<\/span><\/h3>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz_64654\" class=\"cz_grid_p cz_64654\"><div class=\"cz_grid cz_grid_1 clr cz_grid_c2 cz_grid_1_no_title cz_grid_1_mid tac\"><div class=\"cz_grid_item cz_grid_first\"><\/div><div class=\"cz_grid_item \"><div data-title=\"ed2\"><a class=\"cz_grid_link \" href=\"https:\/\/en.colaw.uobaghdad.edu.iq\/wp-content\/uploads\/sites\/73\/2026\/03\/ed2.jpeg\" data-xtra-lightbox><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"500\" src=\"https:\/\/en.colaw.uobaghdad.edu.iq\/wp-content\/uploads\/sites\/73\/2026\/03\/ed2-600x500.jpeg\" class=\"attachment-codevz_600_600\" alt=\"\" title=\"ed2\" \/><div class=\"cz_grid_details\"><i class=\"fa fa-search cz_grid_icon\"><\/i><\/div><\/a><\/div><\/div><div class=\"cz_grid_item \"><div data-title=\"ed3\"><a class=\"cz_grid_link \" href=\"https:\/\/en.colaw.uobaghdad.edu.iq\/wp-content\/uploads\/sites\/73\/2026\/03\/ed3.jpeg\" data-xtra-lightbox><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"500\" src=\"https:\/\/en.colaw.uobaghdad.edu.iq\/wp-content\/uploads\/sites\/73\/2026\/03\/ed3-600x500.jpeg\" class=\"attachment-codevz_600_600\" alt=\"\" title=\"ed3\" \/><div class=\"cz_grid_details\"><i class=\"fa fa-search cz_grid_icon\"><\/i><\/div><\/a><\/div><\/div><\/div><\/div>[\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text] The College of Law \u2013 University of Baghdad discussed a Master\u2019s thesis entitled \u201cThe Role of Public Prosecution in &#8230; <a class=\"cz_readmore cz_readmore_no_icon\" href=\"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=9408\"><span>more<\/span><\/a><\/p>\n","protected":false},"author":205,"featured_media":9410,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[3,8],"tags":[],"class_list":["post-9408","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-latest-news","category-criminal"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.8 -
