The session took place in the Moot Court Hall at the college.<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px;\">The discussion committee consisted of:<\/span><\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li><strong><span style=\"font-size: 18px;\">Prof. Dr. Saja Muhammad Abbas (Chairman)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px;\">Asst. Prof. Dr. Taghreed Muhammad Qadouri (Member)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px;\">Lecturer Dr. Rabab Khalil Ibrahim (Member)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px;\">Asst. Walid Mirza Hamza (Member and Supervisor)<\/span><\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px;\">The thesis aimed to highlight the most important governing principles of administrative authority in imposing contractual penalties on contractors.<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px;\">The thesis included two main chapters:<\/span><\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong><span style=\"font-size: 18px;\">Chapter One: The Principle of Legitimacy of Administrative Authority in Imposing Contractual Penalties<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px;\">Chapter Two: The Principle of Legal Protection for the Contractor Against Contractual Penalties<\/span><\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px;\">The study concluded with several recommendations, the most important being:<\/span><\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong><span style=\"font-size: 18px;\">The necessity for the legislator to intervene by enacting a comprehensive and conclusive law on administrative contracts that covers all types of contracts, regulates their conclusion, execution, and dispute resolution mechanisms.<\/span><\/strong><\/li>\n<li>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px;\">The recommendation to assign jurisdiction over disputes arising from the imposition of contractual penalties on contractors to the Administrative Judiciary, in line with established legal doctrine in numerous studies, given its specialized competence in these types of contracts and its better understanding of their philosophy and the role of administration. This, however, should be stipulated in a clear and explicit legal text.<\/span><\/strong><\/p>\n<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz_70411\" class=\"cz_grid_p cz_70411\"><div class=\"cz_grid cz_grid_1 clr cz_grid_c2 cz_grid_l2 cz_grid_1_no_title cz_grid_1_mid tac\"><div class=\"cz_grid_item cz_grid_first\"><\/div><div class=\"cz_grid_item
