The defence took place in the college\u2019s conference hall.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The examination committee was composed of:<\/span><\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Ali Fawzi Ibrahim \u2013 Chairman<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Haider Faleh Hassan \u2013 Member<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Asst. Prof. Dr. Haifa Mazher Falhi \u2013 Member<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Asst. Prof. Dr. Andalus Hamed Abd \u2013 Member<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Asst. Prof. Dr. Hadeel Saad Ahmed \u2013 Member<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Akram Mohammed Hussein \u2013 Member and Supervisor<\/span><\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The dissertation aimed to clarify the circumstances under which the seller in an international sales contract is obligated to preserve goods that are in their possession or under their control, as well as the corresponding obligations on the buyer. It addressed the definition and legal nature of this obligation, the consequences of breaching it, and the situations in which a party may be exempt from liability.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The dissertation was structured into three chapters:<\/span><\/strong><\/p>\n<ul style=\"text-align: justify\">\n<li><strong><span style=\"font-size: 18px\">Chapter One: The nature of the obligation to preserve goods in international sales contracts<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Chapter Two: Legal provisions governing the obligation to preserve goods<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Chapter Three: Legal consequences of breaching the preservation obligation<\/span><\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The dissertation concluded with several key recommendations, including:<\/span><\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li><strong><span style=\"font-size: 18px\">Establishing a specific legal framework to regulate the obligation to preserve goods.<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Amending Article 77 of the CISG, which currently uses both mandatory and discretionary language, leading to ambiguity. The proposed revised text reads:<\/span><\/strong><br \/>\n<blockquote><p><strong><span style=\"font-size: 18px\"><em>\u201cThe party obligated to preserve the goods must take necessary measures to mitigate any potential loss. Failure to do so will result in the forfeiture of the right to claim full compensation or preservation costs, which shall be reduced by the amount that could have been avoided through such measures.\u201d<\/em><\/span><\/strong><\/p><\/blockquote>\n<\/li>\n<li><strong><span style=\"font-size: 18px\">Amending Article 85 of the CISG to clarify that:<\/span><\/strong><br \/>\n<blockquote><p><strong><span style=\"font-size: 18px\"><em>\u201cThe seller shall be obligated to preserve the goods in their possession or under their control and shall bear the preservation costs, with the right to recover them later. The seller shall have the right to retain the goods until all incurred expenses are fully reimbursed.\u201d<\/em><\/span><\/strong><\/p><\/blockquote>\n<\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">This dissertation contributes to refining legal interpretations and bridging gaps in the international sale of goods framework, with a focus on enhancing legal certainty and commercial fairness.<\/span><\/strong><\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz7190\" class=\"cz7190 slick arrows_mlr no_dots\"
