{"id":6854,"date":"2025-05-23T20:58:11","date_gmt":"2025-05-23T20:58:11","guid":{"rendered":"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=6854"},"modified":"2025-05-23T20:58:11","modified_gmt":"2025-05-23T20:58:11","slug":"the-college-of-law-discusses-a-dissertation-on-guarantees-in-donation-contracts","status":"publish","type":"post","link":"https:\/\/en.colaw.uobaghdad.edu.iq\/?p=6854","title":{"rendered":"The College of Law Discusses a Dissertation on Guarantees in Donation Contracts."},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The College of Law at the University of Baghdad discussed a dissertation titled &#8220;Guarantees in Donation Contracts&#8221; by student Mustafa Mohammed Abdul Karim, from the Private Law, on Monday, May 19, 2025, in the Model Courtroom at the college.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The examination committee consisted of the following members:<\/span><\/strong><\/p>\n<ul style=\"text-align: justify\">\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Jalil Hassan Bshat (Chairman)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Haider Hassan Faleh (Member)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Ali Mutshar Abdul Sahib (Member)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Asst. Prof. Dr. Samira Hussein Muhsin (Member)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Asst. Prof. Dr. Hazem Akram Sallal (Member)<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Prof. Dr. Hamid Sultan Ali (Member and Supervisor)<\/span><\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The dissertation aimed to shed light on the distinctive characteristics of donation contracts that, in one way or another, affect the obligation of guarantee within these contracts. It also explored the forms of guarantees in each type of donation contract, whether addressed in legal texts or in Islamic jurisprudence.<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The dissertation comprised three chapters:<\/span><\/strong><\/p>\n<ul style=\"text-align: justify\">\n<li><strong><span style=\"font-size: 18px\">Chapter One discussed the concept of guarantee in donation contracts from both legal and jurisprudential perspectives.<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Chapter Two covered guarantees in donation contracts related to ownership and usufruct.<\/span><\/strong><\/li>\n<li><strong><span style=\"font-size: 18px\">Chapter Three examined guarantees in donation contracts related to work and suretyship.<\/span><\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">The dissertation concluded with several recommendations, the most significant of which were:<\/span><\/strong><\/p>\n<ol>\n<li style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">Amending Article (604) of the Iraqi Civil Code, which currently states:<\/span><\/strong><br \/>\n<strong><span style=\"font-size: 18px\"><em>&#8220;A minor owns the property gifted to him by his guardian as soon as the donor effects the gift, as long as the property remains in his possession or is held as a deposit or loan by another and does not require physical receipt.&#8221;<\/em><\/span><\/strong><br \/>\n<strong><span style=\"font-size: 18px\">The proposed amendment reads:<\/span><\/strong><br \/>\n<strong><span style=\"font-size: 18px\"><em>&#8220;Ownership of property gifted by the guardian to the minor is transferred as soon as the guardian expresses his intention to donate it, as long as the property is in the minor\u2019s possession or is held as a deposit or loan by another and does not require physical receipt.&#8221;<\/em><\/span><\/strong><\/li>\n<li>\n<p style=\"text-align: justify\"><strong><span style=\"font-size: 18px\">Amending Article (1008) of the Iraqi Civil Code, which currently defines suretyship as:<\/span><\/strong><br \/>\n<strong><span style=\"font-size: 18px\"><em>&#8220;Adding one liability to another in the demand for the fulfilment of an obligation.&#8221;<\/em><\/span><\/strong><br \/>\n<strong><span style=\"font-size: 18px\">The proposed amendment is:<\/span><\/strong><br \/>\n<strong><span style=\"font-size: 18px\"><em>&#8220;A contract by which a person guarantees the performance of an obligation by undertaking to the creditor that he will ensure its fulfilment if the debtor fails to do so himself.&#8221;<\/em><\/span><\/strong><\/p>\n<\/li>\n<\/ol>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz_42606\" class=\"cz_grid_p cz_42606\"><div class=\"cz_grid
