Prof. Dr. Sameera Hussein Muhaysin \u2013 Member<\/span><\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"803\" data-end=\"858\">\n<p class=\"\" data-start=\"805\" data-end=\"858\"><strong><span style=\"font-size: 18px\">Prof. Dr. Hameed Sultan Ali \u2013 Member and Supervisor<\/span><\/strong><\/p>\n<\/li>\n<\/ul>\n<p class=\"\" style=\"text-align: justify\" data-start=\"860\" data-end=\"1145\"><strong><span style=\"font-size: 18px\">\ud83d\udd35 Dissertation Objective:<\/span><\/strong><br data-start=\"890\" data-end=\"893\" \/><strong><span style=\"font-size: 18px\">The dissertation aimed to develop a legal framework for addressing the issue of contract rescue by examining the position of the Iraqi Civil Code, comparative legal systems, legal scholarship, Islamic jurisprudence, and judicial rulings on the subject.<\/span><\/strong><\/p>\n<p class=\"\" style=\"text-align: justify\" data-start=\"1147\" data-end=\"1224\"><strong><span style=\"font-size: 18px\">\ud83d\udfe3 Dissertation Structure:<\/span><\/strong><br data-start=\"1177\" data-end=\"1180\" \/><strong><span style=\"font-size: 18px\">The dissertation consisted of four chapters:<\/span><\/strong><\/p>\n<ul style=\"text-align: justify\" data-start=\"1225\" data-end=\"1527\">\n<li class=\"\" data-start=\"1225\" data-end=\"1281\">\n<p class=\"\" data-start=\"1227\" data-end=\"1281\"><strong><span style=\"font-size: 18px\">Chapter One explored the concept of contract rescue.<\/span><\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"1282\" data-end=\"1355\">\n<p class=\"\" data-start=\"1284\" data-end=\"1355\"><strong><span style=\"font-size: 18px\">Chapter Two addressed the scope of the theory and its justifications.<\/span><\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"1356\" data-end=\"1441\">\n<p class=\"\" data-start=\"1358\" data-end=\"1441\"><strong><span style=\"font-size: 18px\">Chapter Three examined the methods of contract rescue during the formation stage.<\/span><\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"1442\" data-end=\"1527\">\n<p class=\"\" data-start=\"1444\" data-end=\"1527\"><strong><span style=\"font-size: 18px\">Chapter Four discussed the methods of contract rescue during the performance stage.<\/span><\/strong><\/p>\n<\/li>\n<\/ul>\n<p class=\"\" style=\"text-align: justify\" data-start=\"1529\" data-end=\"1558\"><strong><span style=\"font-size: 18px\">\ud83d\udfe4 Key Recommendations:<\/span><\/strong><\/p>\n<ol data-start=\"1559\" data-end=\"2138\">\n<li class=\"\" style=\"text-align: justify\" data-start=\"1559\" data-end=\"1893\">\n<p class=\"\" data-start=\"1562\" data-end=\"1893\"><strong><span style=\"font-size: 18px\">The dissertation recommended that the Iraqi legislature gradually adopt contract rescue as a principle by introducing alternative remedies and limiting the use of nullification and termination. It called for clear and explicit legal provisions outlining mechanisms for contract rescue, potentially incorporated into the Civil Code.<\/span><\/strong><\/p>\n<\/li>\n<li class=\"\" style=\"text-align: justify\" data-start=\"1895\" data-end=\"2013\">\n<p class=\"\" data-start=\"1898\" data-end=\"2013\"><strong><span style=\"font-size: 18px\">Expanding the authority of judges to impose compensation on the harmed party instead of resorting to nullification.<\/span><\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"2015\" data-end=\"2138\">\n<p class=\"\" style=\"text-align: justify\" data-start=\"2018\" data-end=\"2138\"><strong><span style=\"font-size: 18px\">Prioritizing solutions that support the continuation and rescue of contracts over those that lead to their invalidation.<\/span><\/strong><\/p>\n<\/li>\n<\/ol>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz1155\" class=\"cz1155 slick arrows_mlr no_dots\"
