The College of Law at the University of Baghdad discussed a master\u2019s thesis in the private law branch of the student, Wafaa Falih Hassan, tagged with (Marriage Mediation Contract – Comparative Study) on Wednesday 5\/10\/2022 in the conference hall of the college.<\/strong><\/span><\/p>\n

The discussion committee consisted of Prof. Dr. Saad Hussein Abed as Chairman, Prof. Hamid Sultan Ali as a member, Assistant Professor Dr. Raqiah Abdul-Jabbar Ali as a member, and Prof. Dr. Haider Falih Hassan as a member and supervisor.<\/strong><\/span><\/p>\n

This thesis aims at that the marriage mediation contract has spread widely in many Western countries, especially France, in addition to the emergence of features of the presence of this contract in some Arab countries, including Iraq, where the profession of a marriage mediator has become one of the necessary professions in the life of contemporary societies, due to the development which \u00a0has occurred on the social and economic relations of individuals, as one of the alternative ways to overcome the effects of spinsterhood at the collective and individual levels.<\/strong><\/span><\/p>\n

The thesis also included three chapters, the first of which dealt with the nature of a marriage mediation contract, the second chapter, the pillars of a marriage mediation contract, and the third chapter dealt with the effects of a marriage mediation contract.<\/strong><\/span><\/p>\n

The most important recommendations of the study The mediator must be defined and the conditions that must be provided in it to be able to practice the profession of mediation in the marriage contract. The Iraqi legislator must specify the obligations of the parties to the contract. The Iraqi legislator must provide for the protection of the sanctity of private life from abuse, whether the abuse is committed by the mediator or the client By disclosing information and secrets that a person has learned about through the conclusion of a mediation contract and using this data and information to achieve material or moral gains.<\/strong><\/span><\/p>\n
