The College of Law at the University of Baghdad discussed a master\u2019s thesis in the criminal law branch of student Aqil Hassoni Ali, tagged with (publication crimes against the course of justice), on Wednesday, 9\/14\/2022, in the conference hall in the college.<\/strong><\/span><\/p>\n

The discussion committee consisted of Prof. Dr. Kazem Abdullah Al-Shamri as the chairperson, the assistant professor Dr. Sabah Sami Daoud as a member, the assistant professor Dr. Ban Hikmat Abdul-Karim as a member, and the assistant professor Dr. Alaa Nasser Hussain as a member and supervisor.<\/strong><\/span><\/p>\n

This thesis aims to study publishing crimes that violate the course of justice, which are considered among the most dangerous crimes for the judicial system because of the danger they cause to its justice. The impartiality and objectivity of those in charge of it, and since the task of the judiciary is to adjudicate the disputes that are presented to it with justice and to consider the accused as a human being with his dignity, feeling and being. Therefore, justice requires the duty to pay attention to his rights, protect him and provide sufficient guarantees for his trial.<\/strong><\/span><\/p>\n

The thesis also included three chapters, the first of which dealt with the nature of publishing crimes that violate the course of justice, the second chapter, publishing crimes that violate the course of justice in the pre-trial procedures stage. As for the third chapter, it deals with the crime of influencing judges and others and the crime of publishing that violates the course of justice at the trial stage.<\/strong><\/span><\/p>\n

The most important recommendations of the study are for the Iraqi legislator to give a definition of the term publishing crimes, including all media in its modern sense, in line with the development taking place in it. Paragraphs concerning the methods and means of modern publicity as a result of the technological development in the Internet and its widely used websites, the Iraqi legislator must amend the text of Article 57 or introduce a new text in the Code of Criminal Procedure that makes the obligation not to discloses the secrets of the investigation explicitly.<\/strong><\/span><\/p>\n
