The college of law at the University of Baghdad discussed a master’s thesis in the criminal law of the student (Hanan Jafar Khalifa), tagged with (legal evidence and its role in proving in the criminal case), on Thursday, corresponding to 5\/9\/2023 on the model courtroom at the college.<\/span><\/strong><\/p>\n

The thesis aims to explain the role of legal evidence in the Iraqi evidence law and comparative legislation, given its importance in criminal evidence, which has not received thorough study, despite the fact that its subject matter has an important and influential impact in creating legal rules and establishing the rules of evidence, which is an important role because the evidence represents a realistic evidence derived from a legislative text in which Justice cannot remain compared to the seriousness of testimony and recognition of the real picture of the crime to be sought from the competent authorities.<\/span><\/strong><\/p>\n

The thesis included two chapters, the first of which dealt with the nature of evidence in criminal evidence and the second chapter legal evidence in terms of its strength in evidence.<\/span><\/strong><\/p>\n

The thesis came up with several recommendations, the most important of which suggests that judges and investigators be introduced into developmental courses to develop their real abilities in extracting incriminating evidence from the facts, inviting the Iraqi legislator to know the legal presumption by a legislative text in the code of Criminal Procedure, that the legislator should stay away from taking conclusive legal evidence as much as possible, and if it is necessary to take it, it is better to take objective rules.<\/span><\/strong><\/p>\n
