The college of law at the University of Baghdad discussed a master’s thesis in the public law of the student (Amal Karim Bandar), marked with (guarantees of imposing general administrative penalties in Iraqi law), on Tuesday, 23\/7\/2024 to the model courtroom at the college.<\/span><\/strong><\/p>\n

The thesis aims to study and analyse the legal texts through which it is possible to find out the position of the Iraqi legislator and comparative systems such as the Egyptian legislation in this type of sanctions and how the Iraqi legislator dealt with this issue by researching the legal guarantees, whether objective or procedural, to protect the interests of individuals from the arbitrariness of the administration.<\/span><\/strong><\/p>\n

The thesis included three chapters, the first of which dealt with the concept of general administrative penalties, the second chapter dealt with the objective guarantees of general administrative penalties, and the third chapter dealt with procedural and formal guarantees of general administrative penalties.<\/span><\/strong><\/p>\n

The thesis came out with several recommendations, the most important of which is the recommendation of the Iraqi legislator to adopt a system of administrative sanctions law as a result of the development and expansion of the administration’s activity. It proposes to the Iraqi legislator to impose an administrative confiscation penalty on tools and objects directly related to the violation, especially things harmful to public health or toxic substances.<\/span><\/strong><\/p>\n
