The college of law discussed the master’s thesis in the private law of the student (Shahd Ria Meshaal) and entitled with(compulsory mediation is an alternative means of resolving disputes), on Wednesday, 3\/4\/2024 on the model courtroom at the college.<\/span><\/strong><\/p>\n

The thesis aims to determine what compulsory mediation is, its legal and practical importance and its justification within the framework of the philosophy of alternative means of resolving disputes and determine its basis and legal source, whether from jurisprudence, judiciary or the legislation of the EU countries.<\/span><\/strong><\/p>\n

The thesis included three chapters, the first chapter dealt with the nature of compulsory mediation, the second chapter dealt with the legality of forcing mediation and the conditions for its success, and the third chapter dealt with the scope of resorting to compulsory mediation.<\/span><\/strong><\/p>\n

The thesis came out with several recommendations, the most important of which is the need for Iraqi legislation to encourage citizens to resort to mediation to settle their disputes in order to reduce the volume of disputes before the judiciary, the need to benefit from the developments that have occurred on the principle, rules and provisions of mediation, including compulsory mediation.<\/span><\/strong><\/p>\n
