The College of Law at the University of Baghdad discussed a master’s thesis in the branch of criminal law by student (Ruqaya Mohammed Salman), entitled “Therapeutic Measures in Iraqi Drug and Psychotropic Substances Law No. (50) of 2017,” on Wednesday, October 18, 2023, in the Model Court Hall at the college.<\/span><\/strong><\/p>\n

The thesis aims to address a set of measures for treating addicts away from punishment and considering the addict as a patient and prisoner of drugs, shedding light on the health reality of drug offenders with the intention of using drugs, leading us to their treatment and focusing on the medical perspective first, and then the deterrent punitive perspective second.<\/span><\/strong><\/p>\n

The thesis included two chapters, the first of which discussed the concept of therapeutic measures, and the second chapter discussed the imposition of therapeutic measures.<\/span><\/strong><\/p>\n

The thesis concluded with several recommendations, the most important of which is to propose to the Iraqi legislator to replace the text of Article (32) of the Drug and Psychotropic Substances Law No. (50) of 2017, as it includes a reduction of the imposed punishment for individuals who import and distribute narcotic plants. It also suggests lifting the third paragraph of Article (39) of the Iraqi Drug and Psychotropic Substances Law No. (50) of 2017, as the convicted person does not have the right to refuse the application of therapeutic measures, as it is the right of society to free one of its members from addiction or drug use.<\/span><\/strong><\/p>\n
