The College of Law at the University of Baghdad discussed a master’s thesis in the field of public law by student Ali Hussein Halaw. The thesis, titled “Criteria for Selecting Administration for Contracting in Iraqi Legislation – A Comparative Study,” was discussed on Tuesday, October 17, 2023, in the conference hall of the college.<\/span><\/strong><\/p>\n

The thesis aims to select the criteria for contracting with the administration, which is of great importance in contract implementation, ensuring the achievement of the public interest, and preserving public funds. Adhering to these criteria during the contracting process saves the administration a lot of effort and time and ensures the effectiveness of contract implementation.<\/span><\/strong><\/p>\n

The thesis consisted of three chapters. The first chapter discussed the conceptual framework of contracting criteria and contracting with the administration. The second chapter focused on the concept of technical criteria in selecting the contractor with the administration, while the third chapter addressed the legal and financial criteria for contracting with the administration.<\/span><\/strong><\/p>\n

The thesis concluded with several recommendations, including urging the Iraqi legislature to enact a special law for administrative contracts instead of the General Contracts Law No. 87 of 2004 and the Government Contracts Implementation Instructions No. 2 of 2014. It also recommended the establishment of an electronic system that brings together the Iraqi Ministry of Planning with all state ministries, non-ministerial entities, the Engineers Syndicate, and the Contractors Union. This electronic system would facilitate communication for the purpose of inquiries and responses, reducing effort and routine.<\/span><\/strong><\/p>\n
