The College of Law at the University of Baghdad discussed a master\u2019s thesis in the criminal law branch of the student (Murtada Abdul Rahim Hamdan), entitled (Procedural Self-Regulation in Special Penal Laws – A Comparative Study), on Thursday, 09\/14\/2023, in the college\u2019s model courtroom.<\/span><\/strong><\/p>\n

The thesis aims to practically apply the substantive rules in special penal laws, preserve the country\u2019s internal and external security and stability from danger and crime, and the independence of the military and security establishment with a special system and laws.<\/span><\/strong><\/p>\n

The thesis included two chapters, the first of which dealt with aspects of procedural self-regulation in investigation, evidence collection, and preliminary investigation in special procedural criminal laws, and the second chapter dealt with procedural self-regulatory aspects in trial, appeal, and implementation of judgments in special criminal laws.<\/span><\/strong><\/p>\n

The thesis came out with several recommendations, the most important of which is that the nature of some crimes cannot be applied by general laws to them due to the difference in the nature of the legal rules and the nature of the crime committed, as is the case in military, police, terrorist and traffic crimes, and that the body responsible for investigating, collecting evidence and preliminary investigation in special procedural criminal laws differs.
