The College of Law at the University of Baghdad discussed a master’s thesis in the Public Law branch of the student Mahmoud Abdel-Rahim Abdel-Razzaq tagged with (Provisions of registration in the electoral register and adjudication of disputes arising from it under the Constitution of the Republic of Iraq for the year 2005 – a comparative study) under the supervision of Prof. Dr. Maha Bahjat Younes, on Wednesday corresponding to 7\/6\/2023 at the conference hall in the college.<\/span><\/strong><\/p>\n

This thesis aims to analyze the constitutional, legal and practical problems that faced the voter registration process in Iraq in the parliamentary elections that were held since 2005 and the last elections of 2021, and try to identify the negative aspects that marred the voter registration process and find appropriate solutions in order to strengthen the base of the electorate and achieve successful participation in the elections.<\/span><\/strong><\/p>\n

The thesis also included three chapters, the first of which dealt with the conceptual framework for the process of registration in the electoral register, the second chapter dealt with the legal framework for the registration process in the electoral register in the comparative countries and Iraq, and the third chapter dealt with the legal framework for the process of monitoring the electoral register in the comparative countries and Iraq.<\/span><\/strong><\/p>\n

The most important recommendations reached by the study is to unify the legal framework for the electoral process in all its stages and aspects through a single electoral law and not to be distracted by the abundance of regulations and decisions issued while giving some authority to the commission in order to put instructions and executive decisions to facilitate the implementation of the law and detail its provisions, amending the text of Article 16, Paragraph 5 of the law Iraqi Parliament Elections No. 9 of 2020, which states (a voter may not be registered in more than one electoral district) because the district includes several polling centers, meaning that the voter\u2019s name may be repeated in more than one center and electoral registry, and this may lead to fraud through repeated voting From some tampering within the same constituency, and therefore the paragraph must be amended by stipulating (a voter may not be registered in more than one center, station, or electoral registry).<\/span><\/strong><\/p>\n
