The College of Law at the University of Baghdad discussed a master’s thesis entitled “The Role of Constitutional Judiciary in Establishing the Principles of Good Governance: A Comparative Study,” submitted by Hiba Najm Abdullah, a postgraduate student in the Public Law Branch. The discussion was held on Monday, August 31, 2026, in the Moot Court Hall at the College.

The discussion committee consisted of:

Prof. Dr. Maha Bahjat Younis — Chairman
Prof. Dr. Rahim Hussein Musa — Member
Dr. Hassan Ali Abdul-Hussein — Member
Assist. Prof. Dr. Sura Harith Abdul-Kareem — Member and Supervisor

The thesis aimed to define the concept of good governance and identify its fundamental components, as well as distinguish it from other similar or closely related concepts. It also examined the dimensions covered by good governance, the principles upon which it is based, the constitutional foundation of these principles, and the extent to which they have been adopted in comparative constitutional systems.

The thesis comprised three chapters. The first chapter addressed the concept of good governance. The second examined the areas of constitutional judicial intervention in achieving good governance. The third chapter explored the approaches adopted by constitutional courts in establishing the foundations of good governance.

The thesis concluded with several recommendations, the most important of which were:

Calling on the Iraqi legislator to include an explicit provision in the Constitution of the Republic of Iraq of 2005 referring to the concept of good governance as a constitutionally binding principle for all state authorities.

Calling on the Iraqi legislator to add a provision to the Constitution of the Republic of Iraq of 2005 recognizing the right to access information, thereby enabling individuals to obtain information held by public authorities.

Calling for the expeditious enactment of the Federal Oil and Gas Law, given its significant importance in limiting the depletion of oil and gas resources and regulating their exploitation.
