The College of Law at the University of Baghdad discussed a master’s thesis entitled “Electronic Evidence in Disciplinary Liability under Iraqi Law – A Comparative Study,” submitted by Zahraa Bashar Dhahir, in the Public Law. The discussion was held on Wednesday, August 26, 2026, in the Model Court Hall at the College.

The Discussion Committee consisted of:

The thesis aimed to explain the concept, characteristics, types, and legal nature of electronic evidence, as well as to examine its role in establishing or disproving the disciplinary liability of public employees and the extent of its legal evidentiary value. It also analyzed the position of the Iraqi legislator and compared it with French, Egyptian, Emirati, and Jordanian legislation, thereby highlighting the need to develop the legal framework governing electronic evidence in the disciplinary field.

The thesis consisted of three chapters. Chapter One addressed the conceptual framework of electronic evidence. Chapter Two examined the legal basis and scope of resorting to electronic evidence in disciplinary liability. Chapter Three dealt with the evidentiary value of electronic evidence and its role in establishing or disproving disciplinary liability.

The thesis concluded with several recommendations, most notably:

First: The need for the Iraqi legislator to establish a comprehensive legal framework governing electronic evidence in the administrative and disciplinary fields, specifying the conditions for its admissibility, evidentiary value, and the safeguards governing reliance upon it.

Second: The establishment of clear procedural rules for the collection, preservation, and examination of electronic evidence in a manner that ensures its integrity and protects it from alteration or tampering, thereby enhancing its reliability and evidentiary value before the competent authorities.

Third: The development and strengthening of specialized administrative technical units responsible for examining digital evidence, providing them with qualified personnel, and enhancing training and professional development programs for administrative investigators in the field of handling electronic evidence.
