The College of Law – University of Baghdad discussed a doctoral dissertation titled “The Legal System of Litigation Involving Legal Persons,” submitted by the student Abbas Abadi Ni’mah, in the Private Law branch, on Thursday, 11/6/2026, at the college’s Conference Hall.

The examination committee consisted of the following professors:

  1. Prof. Dr. Jalil Hassan Bashat – Chairman
  2. Prof. Dr. Haider Faleh Hussein – Member
  3. Prof. Dr. Ali Mutashar Abdul Sahib – Member
  4. Asst. Prof. Dr. Laftah Hamel Alwan – Member
  5. Prof. Dr. Samira Hussein Muhsin – Member
  6. Prof. Dr. Ali Fawzi Ibrahim – Member and Supervisor

The dissertation aimed to establish an integrated legal framework for litigation involving legal persons, in a way that enhances the protection of rights and the stability of legal positions. It also examined the practical impact of Civil Procedure Law across legal systems in Iraq, Egypt, and France, along with a study of selected judicial precedents in English law.

The dissertation was divided into three chapters: the first addressed the conceptual framework of legal persons, the second examined the procedural system of litigation involving legal persons, and the third analyzed the procedural rules governing such litigation and their legislative and judicial applications.

The study concluded with several recommendations, most notably:

  1. Amending Article (4) of the Iraqi Civil Procedure Law.
  2. Clarifying the distinction between a litigant and their legal representative, and addressing legislative gaps in cases requiring proper representation—particularly by amending Article (173) to stipulate that appeals are not accepted unless signed by a lawyer admitted before the court that issued the judgment.
  3. Establishing a unified procedural system governing litigation involving legal persons and third-party claims, characterized by clarity and consistency with the legal provisions regulating legal entities.
