The College of Law – University of Baghdad discussed a PhD dissertation entitled “The Legal Regulation of State Real Estate Sale Contracts – A Comparative Study” by the student Enas Moayad Jassim, from the Department of Public Law, on Thursday 26/2/2026, in the Conference Hall.
The examination committee consisted of the following professors:

The study aimed to clarify the importance of the legal regulation of contracts for the sale of state-owned real estate, given the increasing importance of real property at the present time. It also sought to achieve stability in state-owned real estate and legislative reform concerning real estate sale contracts and the mechanisms for transferring real estate property.
The dissertation consisted of three chapters:
The first chapter examined the nature of state-owned real estate property.
The second chapter discussed the concept of contracts for the sale of state real estate.
The third chapter addressed the legal mechanisms governing contracts for the sale of state-owned real estate.
The dissertation concluded with several recommendations, the most important of which include:
First: The legislator should establish a legal provision specifying the necessary conditions for the real estate property being sold. Since the general rules relate to real estate in general, special conditions must be set for the specific real estate subject to sale.
Second: The administrative authority should be obligated to create an annually updated database showing the volume of state-owned real estate through an annual inventory, in order to identify surplus properties that can be utilized or offered for sale to achieve the public interest.
Third: Expanding the jurisdiction of the Administrative Court to include all administrative contracts so that it can play a genuine and effective role.
