The College of Law – University of Baghdad discussed a Master’s thesis entitled “The Role of Public Prosecution in the Execution of Criminal Penalties” by the student Mohammed Qasim Mahmoud, from the Department of Criminal Law, on Thursday, 26/2/2026, in the Model Court Hall at the college.

The examination committee consisted of the following professors:

1.Prof. Dr. Nawal Tariq Ibrahim (Chairman)

2.Prof. Dr. Zain Al-Abidin Awad Kazim (Member)

3.Assist. Prof. Dr. Samer Saadoun Aboud (Member)

4.Prof. Dr. Sabah Sami Dawood (Member and Supervisor)

The thesis aimed to highlight the role of the public prosecution during the stage of executing criminal penalties by focusing on the legal mechanisms granted to it by the legislator and identifying the positive and negative aspects within the provisions of the current Public Prosecution Law.

The thesis consisted of three chapters:

The first chapter discussed the conceptual framework of the Public Prosecution institution.

The second chapter examined the role of the Public Prosecution in supervising criminal procedures.

The third chapter addressed the supervision of the Public Prosecution over issues related to the execution of criminal penalties.

The thesis concluded with several recommendations, the most important of which were:

1.Removing the term “establishes” from Article (1) of the current Public Prosecution Law No. 49 of 2017 and replacing it with the term “organizes the Public Prosecution institution.”

2.The Iraqi legislator should enact a special law on the execution of criminal penalties and grant the judge responsible for executing criminal penalties broad powers and duties in order to achieve the purposes of punishment in reform and social rehabilitation.

3.Including the Public Prosecution within Article (271) of the Criminal Procedure Law No. 23 of 1971 among the parties entitled to request a retrial, since it represents the public interest.
