The College of Law at the University of Baghdad discussed a master’s thesis in the international law branch of the student Basma Salal Taha, tagged with (the impact of climate change on the outbreak of armed conflicts), on Thursday 11/17/2022 in the model courtroom in the college.
The discussion committee consisted of Messrs. Assistant Professor, Dr. Lama Abdel-Baqi Mahmoud, Chairman, Assistant Professor, Dr. Hussam Hamid Shehab, Member, Dr. Nibras Ibrahim Muslim, Member, Assistant Professor, Dr. Mahmoud Khalil Jaafar, Member and Supervisor.
This thesis aims to point out that the importance of the subject mainly is that it takes an international dimension related to the disclosure of the legal regulation of the climate as it provides the general foundations for protection or not, and to identify the justifications and factors that cause climate pollution, and to know the mechanisms that international organizations follow in protection. Climate protection is of great importance in view of the novelty of the experience and the accompanying events and problems in recent times, as the levels of protection vary from one country to another, according to the development of its economic and political system.
The thesis also included three chapters, the first of which dealt with the conceptual framework of climate change and armed conflict, the second chapter dealt with the international efforts exerted in the field of combating climate change and their effectiveness, while the third chapter dealt with the impact of climate change on the outbreak of armed conflict and its applied cases.
The most important recommendations reached by the study are the absence of all international texts for climate protection from determining international responsibility, as there is no meaning to the texts of any international agreement without these texts being binding, that is, they must be accompanied by a penalty for violating them, and the mechanism for determining international liability for damages must be activated The creation of an international organization for environment and development similar to the United Nations, concerned only with environmental affairs, dealing with threats to the planet and supervising the implementation of its decisions.
