The College of Law at the University of Baghdad discussed a master’s thesis in the private law branch of student Safaa Hussein Lafta, tagged with (compensation through guarantee funds – a comparative study) on Wednesday, October 26, 2022 in the conference hall of the college.

The discussion committee consisted of Prof. Dr. Jalil Hassan Al-Saedy as Chairman, Assistant Professor Dr. Kazem Karim Ali as a member, Assistant Professor Dr. Amer Ghanem Alwan as a member, and Assistant Professor Dr. Ali Mutashar Abdel Sahib as a member and supervisor.

This thesis aims to guarantee the right to compensation in light of developments in society and the increase in accidents and the increase in their risks. Achieving social justice, all the way to finding a social balance between those affected within society, so that there is no harm without compensation.

The thesis also included four chapters, the first of which dealt with the nature of compensation through guarantee funds, the second chapter was rooting for compensation through guarantee funds, while the third chapter included the legal regulation of compensation through guarantee funds, and the fourth chapter dealt with the applications of compensation through guarantee funds.

The most important recommendations of the study are for the Iraqi legislator to issue a law to compensate for the damages of natural disasters, allowing the adoption of the idea of ​​compensation through guarantee funds, following the mechanism of compensation through guarantee funds, and benefiting from the French experience that has proven its effectiveness, adding a branch in the Iraqi Public Health Law No. (89) for the year 1981 under the title (Compensation for Medical Accidents Damage) includes the establishment of a guarantee fund that guarantees compensation for victims of medical accidents that are not caused by medical error, negligence or negligence, called (The Medical Damage Victims Guarantee Fund).
