The College of Law at the University of Baghdad discussed a PhD thesis titled “The Legal Status of the Investor in the Telecommunications Sector – A Comparative Study” by the student Rasel Jafar Jassim, at the Department of Private Law, on Wednesday, 28 May 2025, in the College’s conference hall.

The discussion committee was composed of:

The dissertation aimed to clarify the concept of the investor in the telecommunications sector, define its legal meaning and characteristics, and identify the legal requirements for issuing telecommunications licenses by the regulatory authority responsible for the sector. Additionally, it addressed the rights and obligations of the investor towards the licensee, beneficiaries of telecommunications services, and competing investors.

The dissertation included three chapters:

  • Chapter One discussed the nature of the investor in the telecommunications sector.
  • Chapter Two addressed the obligations and rights of the investor.
  • Chapter Three covered oversight of the investor and their legal responsibility.

The dissertation concluded with several recommendations, most notably:

  1. Calling on the Iraqi legislator to enact a comprehensive law regulating investment in the telecommunications sector from all legal, technical, and financial aspects, consistent with the modern technical and technological developments in the sector.
  2. The necessity to regulate the legal positions of the licensee, investor, and service beneficiary in a manner that meets the requirements of this investment.
  3. Proposing an amendment to Article 29 of the Iraqi Investment Law to add a new clause exempting telecommunications investment projects from this law’s provisions, similar to the oil, gas, banking, and insurance sectors.
