The College of Law – University of Baghdad Discusses a master’s Thesis on International Compensation Funds for Human Rights Violations

The College of Law at the University of Baghdad held a discussion for a master’s thesis titled:
“International Compensation Funds for Human Rights Violations”
by Shahad Hamad Matar Hassan, in the Department of International Law, on Sunday, May 25, 2025, in the Model Courtroom at the College.

The examination committee consisted of the following members:

  1. Prof. Dr. Hadi Naim Khalaf – Chairman

  2. Prof. Dr. Haider Abdul Mohsen Shahid – Member

  3. Asst. Prof. Dr. Mustafa Salem Abd – Member

  4. Prof. Dr. Husam Abdul Amir Khalaf – Member and Supervisor

The thesis aimed to explore the establishment of international funds designed to ensure effective compensation for victims and their families, as well as to support the financing of rehabilitation programs. The study emphasized that the state is legally obligated—under its constitution and laws—to guarantee protection and compensation for victims by implementing a comprehensive legal framework for reparation programs addressing all forms of harm.

The thesis was structured into three chapters:

  • Chapter One: Conceptual Framework of Compensation Funds

  • Chapter Two: Structure and Legal Status of International Funds

  • Chapter Three: Responsibility for Victim Compensation and Practical Applications of International Funds

The thesis concluded with several key recommendations, including:

  1. Establishing an effective system to fully protect victims in Iraq by implementing a compensation mechanism through guarantee funds, particularly in light of the large number of victims due to wars and repeated crises in the country.

  2. Ensuring that compensation funds are available before all national and international judicial bodies, so victims can receive fair and appropriate compensation.

  3. Expanding the definition of “victim” and “violations” beyond the four core crimes under the jurisdiction of the International Criminal Court.
