The College of Law at the University of Baghdad discussed a doctoral dissertation titled “The Administrative Regulation of Property Rights as a Means of Protecting Public Order”, by Elaf Saeed Majid, in the Public Law, on Monday, May 5, 2025, in the college’s conference hall.

The examination committee consisted of the following members:

  1. Prof. Dr. Waleed Mirza Hamza (Chairman)
  2. Prof. Dr. Haider Hassan Shtawi (Member)
  3. Prof. Dr. Issa Turki Khalaf (Member)
  4. Asst. Prof. Dr. Sura Harith Abdul Kareem (Member)
  5. Asst. Prof. Dr. Nada Abdul-Kadhim Hussein (Member)
  6. Asst. Prof. Dr. Taghreed Mohammed Qaddouri (Member and Supervisor)

The dissertation aimed to identify key theoretical and scientific concepts related to the topic, study the legislative philosophy adopted by the state when imposing restrictions on property rights, and clarify the legal basis for the administrative authority’s power to prohibit, restrict, or regulate property rights.

The dissertation was structured into two chapters:

  • Chapter One discussed the authority of administrative regulation over property rights.
  • Chapter Two examined the restrictions imposed on private property.

The dissertation concluded with several key recommendations, the most important of which were:

  1. Codifying the concept of public order in the state through clear constitutional provisions and defining its role in the operations of administrative regulatory authority, along with establishing limits to prevent abuse of power under the guise of public order.
  2. Ensuring that legislative policies respect the foundational principles set by lawmakers and avoiding any overreach unless it aligns with the state’s philosophy and serves the public interest.
  3. Activating the role of relevant authorities in enforcing certain legislative restrictions on property, emphasizing their importance and the necessity of adhering to the legal texts.
