The College of Law at the University of Baghdad discussed a master’s thesis in the international law branch of the student Batoul Abbas Salman, tagged with (cases of exemption from international responsibility) on Sunday 25/9/2022 in the conference hall of the college.
The discussion committee consisted of Prof. Dr. Maha Muhammad Ayoub as Chairman, Assistant Professor Dr. Lama Abdel-Baqi Mahmoud as a member, Assistant Professor Dr. Mustafa Salem Abed as a member, and Assistant Professor Dr. Mahmoud Khalil Jaafar as a member and supervisor.
This thesis aims to establish the theoretical foundations and legal rules of the system of international responsibility in public international law, especially the cases of exemption from international responsibility that are its backbone, in order to reach a legal understanding as comprehensive as possible on this issue.
The thesis also included three chapters, the first of which dealt with the concept of exemption from international responsibility, the second chapter dealt with the impediments of international responsibility, and the third chapter dealt with the circumstances precluding illegality.
The most important recommendations of the study are the need to distinguish between the circumstances precluding illegality and the impediments to international responsibility. Seeking to find a body that represents a supreme authority for all countries, entrusted with the task of determining the legality of an international act, whether it is legitimate or illegal.
