The College of Law at the University of Baghdad has discussed a dissertation entitled “The Principle of Legality and Smart Administration Actions: A Study on the Impact of Artificial Intelligence on Administrative Operations” by the student (Haider Mohammed Hussein) from the Public Law. The discussion took place on Monday, April 7, 2025, in the College’s Conference Hall.

The discussion committee consisted of the following members:

  • Prof. Dr. Bahan Salah Abdulqader – Member
  • Assist. Prof. Dr. Taghreed Mohammed Qadouri – Member

  • Prof. Dr. Walid Marza Hamza – Member and Supervisor

The dissertation aimed to highlight the requirement of “purpose” in the legality of smart administration decisions, particularly in relation to the collection and use of personal data. It also addressed the legal frameworks governing this aspect and the necessity for the administration to precisely and proactively define legitimate purposes when processing data. This ensures the protection of privacy and constitutional rights, while minimizing the misuse of artificial intelligence technologies in administrative functions.

The dissertation included two chapters: the first focused on the nature of smart administrative decisions and their application in administrative activities, while the second examined the guarantees of the legality of these decisions.

The dissertation concluded with several recommendations, the most important of which are:

  1. The Iraqi legislator should enact a specific law on artificial intelligence and personal data, which includes the fundamental principles that encourage investment in this field.
  2. The establishment of an independent authority responsible for overseeing data protection and the development and operation of artificial intelligence in both the public and private sectors.
  3. Encouraging investment in the field of artificial intelligence in Iraq by providing investment opportunities, establishing consulting institutes, and creating government investment funds to support investment in this advanced technology.
