For the purpose of spreading constitutional and legal awareness among specialists about the rules of procedure of the Federal Supreme Court, the professor at the College of Law / University of Baghdad “Dr. Mosaddeq Adel” published his book tagged “Rules of Procedure of the Federal Supreme Court No. 1 of 2022 between traditional techniques and the requirements of modernity and renewal” in 2022. Which consists of (249) pages.
The book is considered the first among the constitutional literature that addressed the analysis of the texts of the rules of procedure by following the approach of the School of Explanation on the Text and the Scientific School.
This book aims to shed light on the texts of the rules of procedure of the court, analyze the pros and cons of it, determine the nature of the hierarchy of legal rules contained in the texts of the rules of procedure, and analyze the trends of the Federal Supreme Court regarding the procedural and substantive rules of the cases before it in the period preceding and following the entry into force of the rules of procedure. In addition to reviewing the effectiveness of the legislative drafting of the texts of this system and the extent to which they are in line with recent developments in the constitutional judiciary.
The author made several recommendations, perhaps the most important of which is to devote the authority of the Federal Supreme Court to address and reverse judicial precedents and expressly stipulate them in the texts of the new Federal Supreme Court law to be legislated in the future in accordance with Article (92/Second) of the Constitution, and the need to stipulate all provisions related to the interpretation of the texts of the law by the Federal Supreme Court.
