The College of Law at the University of Baghdad – Private Law, discussed the PhD dissertation titled “The Legal System of Drones” by the student Abbas Ni’ma Mohsen on Monday, March 17, 2025, in the conference hall of the college.

The discussion committee consisted of the following members:

The dissertation aimed to study the legal system of drones from a comparative perspective, with the goal of analysing national and international legislations related to them, assessing the sufficiency of current legal frameworks for regulating their use, and highlighting the legal challenges associated with the use of drones in both civil and military fields.

The dissertation included three chapters. The first chapter addressed the nature of drones, the second focused on the legal nature of drones and the applicable private international law rules, while the third chapter discussed civil liability arising from drone-related damages.

The dissertation presented several recommendations, the most important of which are:

  1. The Iraqi legislator should enact a specific law to regulate drones, similar to what the UAE legislator has done.
  2. The process of registering drones should be organized, with the establishment of specialized centres distributed across provinces by the Civil Aviation Authority to facilitate the registration process.
  3. The liability of the drone operator should be based on a presumption of fault, which can be rebutted, for damages caused by drones, in accordance with Article (231) of the Iraqi Civil Code. The following text is suggested: “The drone operator is responsible for the damages caused by the drone unless it is proven that they took sufficient precautions to prevent the harm.”
