The College of Law at the University of Baghdad discussed a master’s thesis in the international law branch of the student Baneen Ahmed Darwish, tagged with (Procedures before the International Court of Justice), on Wednesday 7/9/2022 in the conference hall in the college.

The discussion committee consisted of Prof. Dr. Nazer Ahmed Mandeel as Chairman, Assistant Professor Dr. Mahmoud Khalil Jaafar as a member, Assistant Professor Dr. Hossam Abdel Amir Khalaf as a member, and Prof. Dr. Hadi Naim Al Maliki as a member and supervisor.

This thesis aims at that the procedural system of the International Court of Justice and its mechanism of action and a detailed statement of the procedures followed before it, as the most important aspect of any judicial system is the aspect of procedures. Each judicial system contains specific and organized procedures that must be followed by all parties to the judicial process, starting with the judges and the court administration, and ending with the parties to the case.

The thesis also included three chapters, the first of which dealt with the definition of the International Court of Justice and its competencies, and the second chapter deals with the establishment of the international case and the procedures of the court. The third chapter dealt with the rulings of the International Court of Justice and the mechanism for implementing the judgments.

The most important recommendations of the study are that the number of member states of the United Nations has tripled since its inception, but the composition of judges is still the same, i.e. only fifteen judges. In order to suit the number of member states, amend the statute of the International Court of Justice with regard to jurisdiction, as the problem lies in the fact that the court exercises its jurisdiction based on voluntary jurisdiction, and that there is also compulsory jurisdiction based on states’ acceptance of the court’s jurisdiction.
