The college of Law at the University of Baghdad discussed the master’s thesis in Public Law by the student Heba Abdul Razzaq Nasser, titled “The Legal Organization of Disputes in Social Security – A Comparative Study”, on Thursday, February 20, 2025, at the Leadership Hall in the Faculty.
The discussion committee consisted of:

The thesis aimed to analyze the social and economic guarantees provided by the Pension and Social Security Law to protect workers’ rights from potential risks, such as disability, death, and retirement. It also sought to study the legal provisions found in Law No. (18) of 2023, which deals with the settlement of social security disputes, focusing on identifying shortcomings and proposing alternatives that contribute to the development of the legal system. Additionally, the study aimed to compare the legal approach to resolving these disputes with the legal systems in other countries to draw lessons and provide appropriate recommendations.
The thesis consisted of three chapters:
- The first chapter discussed the legal and international organization of the right to dispute in social security.
- The second chapter focused on the legal organization of disputes according to Iraqi laws.
- The third chapter examined the effects of resolving disputes in social security.
The thesis concluded with several important recommendations, including:
- Raising awareness of social security rights: Social security institutions should raise awareness among insured individuals about their rights and dispute resolution mechanisms related to them through seminars and workshops.
- Enhancing administrative dispute resolution mechanisms: Countries should enhance administrative dispute resolution mechanisms in the field of social security by developing rules and procedures and providing necessary training for workers in this field.
- Expanding the jurisdiction of administrative courts: Iraq should expand the jurisdiction of administrative courts to include all disputes related to social security, in comparison with other countries.
- Activating the role of constitutional courts: Iraq should activate the role of the constitutional court in the field of social security by enabling it to review the constitutionality of laws and regulations related to this field and providing petitioners with the means to challenge violations of the Iraqi Constitution of 2005.

Strengthening the social security system: Governments should work to strengthen social security systems to ensure their ability to provide adequate protection for insured individuals. Additionally, governments should work on raising awareness of the importance of social security and encourage citizens to join social security programs.
