The private law at the College of Law, University of Baghdad, held a scientific seminar entitled (litigation as a means of protecting the rights of the heir), delivered by the lecturer in the private law (Dr. Hamid Sultan Al-Khalidi), and in the presence of post-graduate students, on Tuesday, 26/11/2024 in the building of the college of law.
The seminar aimed to demonstrate the protection caused by legislation to the heir who receives the inheritance from his inheritance by indicating the types of lawsuits, its terms and conditions.
The seminar included several axes, the first axis dealt with the concept of the lawsuit in general and the concept of the inheritance lawsuit with the statement of its conditions and the second axis the statement of the types of lawsuits that protect the rights of the heir and the terms of each and its own provisions.
The seminar came up with several recommendations, the most important of which is to work in order to reduce the material and objective errors that permeate the Sharia sections by making sure of their details, the number of heirs and their conditions before issuing their arguments, the recommendation of the Iraqi legislator to work to adhere to the provisions contained in the texts of the Holy Quran and the Sunnah of the prophet and related to the Sharia sections because the provisions contained in these texts are peremptory texts that cannot be interpreted .
