The college of law at the University of Baghdad discussed a doctoral dissertation in the criminal law of a student (Hassan Mahdi Hamza), tagged with (penal policy in monetary crimes in Iraqi law-a comparative study), on Wednesday, 23/10/2024 at the conference hall at the college.
The dissertation aimed to focus on the role of Criminal Policy in monetary crimes and clarify the relationship between economic policy and Criminal Policy and the relationship of criminal law with economic crime. The currency counterfeiting crimes are different from monetary crimes, although currency or money is the solution because money is wider than currency because it enters supply and demand and changes the price.
The dissertation included three chapters, the first of which dealt with the theoretical framework of the penal policy in monetary crimes, the second chapter dealt with the applications of the criminalization policy in monetary crimes, and the third chapter dealt with the preventive and punitive policy in monetary crimes.
The dissertation came up with several recommendations, the most important of which proposes to the Iraqi legislator to issue legislation for the law on cash control in light of many competencies of regulatory agencies to address the current situation and all the crises that the economy is going through as follows: Article (١) it is prohibited to deal in foreign currency notes or transfer cash from or to Iraq, as well as any pledge denominated in a foreign currency and all purposes involving full or partial conversion or settlement in foreign currency, article (٢) it is prohibited to import or export Iraqi or foreign currency notes of all kinds, as well as financial notes and other transferred values, whatever the resistant currency, except on the terms and conditions appointed by the governor of the central bank by his decision.
