The college of law at the University of Baghdad discussed the doctoral dissertation in the international law of the student (Heba Dia Salah al-Din), marked with (conditions for filing a lawsuit before the International Court of justice), on Thursday, 24/10/2024 on the conference hall at the college.
The dissertation aimed to explain the objective conditions for filing a lawsuit because it is a legitimate means of defense when the right is lost, or obligations are breached and represents a peaceful means of resolving international disputes because international justice plays an important role in maintaining international peace and security through the disputes it resolves and the judgments it issues.
The dissertation included two chapters, the first of which dealt with the requirement of competence and the second chapter with the condition of admissibility.
The dissertation came up with several recommendations, the most important of which is the need to explicitly recognize the capacity of states to defend and protect international legality, the need to develop a law of international procedures to keep pace with the new developments that have occurred in the function of international justice, and proposes to review and determine the conditions for accepting the case before the International Court of Justice clearly and explicitly in the statute of the court.
