The college of law at the University of Baghdad discussed the doctoral dissertation in the criminal law of the student (Aseel Hatem Toman), tagged with (criminal protection of civil contracts – a comparative study), on Monday, 14/10/2024 on the conference hall at the college.
The dissertation aimed to achieve the ethics of contractual transactions in a better way and to confront the assault and its seriousness on trust in dealing between individuals and protect contractual justice by protecting contractual freedom and contractual honesty.
The dissertation included two chapters, the first of which dealt with the nature of criminal protection of civil contracts and the second chapter criminal protection of civil contracts at the pre-contract stage and the convening stage.
The dissertation came up with several recommendations, the most important of which is to invite the Iraqi legislator to include a text within Part V / crimes violating public trust of the Penal Code that deals with the criminal protection of civil contracts, as the proposed text is as follows (without prejudice to any more severe punishment, imprisonment and fine for anyone who violates a civil contract, whether the violation is at the negotiation stage, the convening stage, the form of the contract or its execution), inviting the Iraqi legislator to address fraud crimes in a unified law called (anti-fraud law) that regulates all the provisions of fraud crimes under this law to prevent the phenomenon of fraud, the need to develop (combating drug crimes) including drug fraud, which is among the sections of the fight against organized crime The Ministry of Interior in coordination with other relevant sectors by the Ministry of Health and the syndicate of doctors and pharmacists.
