The college of law at the University of Baghdad discussed a master’s thesis in the criminal law of a student (Rania Jabbar Hussein), labeled (the crime of mediation in the transfer and transplantation of human organs – a comparative study), on Tuesday, corresponding to 10/9/2024 on the model courtroom at the college.

The thesis aims to shed light on the practices introduced by the scientific revolution in the form of transplants the human organs, point out the problems raised by them and the resulting violation of the inviolability and dignity of man, highlight the revolutionary conflict between the human interest in not compromising the integrity of his body and these actions and the position of the law on these operations, as well as shed light on a category of criminals, namely intermediaries, and define the exact concept of the crime of mediation in the transfer and transplantation of human organs.

The thesis included three chapters, the first of which dealt with the crime of mediation in the transfer and transplantation of human organs, the second chapter dealt with the elements of the crime of mediation in the transfer and transplantation of human organs, and the third chapter dealt with the criminal penalty for the crime of mediation in the transfer and transplantation of human organs.

The thesis came out with several recommendations, the most important of which is to amend the text of Article (18) of the law on transplants of human organs and the Prevention of trafficking in them No. 11 for a year 2016 which states that there must be a special intention that the perpetrator’s intention is to transplant the removed organ into the human body to be the text of the article and the anti-human trafficking law no .28 for a year 2012.
