The Continuing Education Unit at the college of Law, University of Baghdad, held a workshop entitled (The requirement of interest in the constitutional lawsuit). The sessions were chaired by Asst.lect. Sura Adeeb Hamid, head of the Continuing Education Unit at the College and presented by Dr. Sura Harith Abdulkarim lecturer in the public law, in the presence of lecturers and college staff, on Monday 8/7/2024
on the virtual courtroom at the college.
The workshop aims to demonstrate the importance of the condition of interest established in accordance with what is stated in the law of civil proceedings no. (83) of the year 1969 amended in Article (6), as well as to demonstrate the practical benefit of the interest recognized and protected by the law, which is intended to be achieved by the plaintiff through recourse to the judiciary, as the condition of interest is considered key and essential for the establishment of a constitutional lawsuit. The constitutional judiciary has decided not to accept any constitutional lawsuit unless the necessary conditions are met.
The workshop included several axes, including a statement of what is meant by interest, the conditions that must be met to consider the interest realized as a condition for recourse to the judiciary, the conditions for accepting the constitutional lawsuit in the Federal Supreme Court System.
The workshop came up with a set of recommendations, the most important of which is that the conditions of interest in the constitutional lawsuit are the same as in the ordinary lawsuit to be legal (legitimate) and to be a personal and direct interest, and thus the text of Article (20) of the rules of procedure has excluded the potential interest as a condition of acceptance of the constitutional lawsuit.
