The college of law at the University of Baghdad discussed the dissertation in the criminal law of the student (Qasim Mohammed Hussein), tagged with (public order in criminal law _ analytical study), on Monday, 24/6/2024 on the conference hall at the college.
The dissertation aims at the legislator’s approval of public order because it is one of the basic ideas when legislating any law to reach the achievement of its goals for which it was developed, to indicate the determinants of public order in the objective Penal base and to identify the elements of public order in the criminal law.
The dissertation included three chapters, the first of which dealt with the conceptual framework of public order in criminal law, the second chapter dealt with the impact of public order in the substantive Penal rule, and the third chapter dealt with the impact of public order in the procedural Penal rule.
The dissertation came up with several recommendations, the most important of which is to take into account the social necessity in criminalization in order to achieve public order, because the origin is permissiveness and the exception is criminalization and punishment, it is not permissible to expand it only if there is a need for the legislator to resort to criminalizing certain behaviour, calling on the Iraqi legislator to make the spreading of terror among people and harming the public interest in crimes critical to public security an aggravating circumstance that requires an increase in punishment to take into account the preservation of Public Order and achieve stability in society.
