The college of law at the University of Baghdad discussed a master’s thesis in the criminal law of the student (Nada Addai jeryan), marked with(criminalization of parental rights in the Iraqi criminal legislation _ analytical study), on Thursday, 13/6/2024 on the model courtroom at the college.
The thesis aims to explain the legislative shortcomings towards parents in criminalization and punishment, submit proposals to amend legislative texts and there should be a text criminalizing the rights of parents and specify deterrent penalties against perpetrators, and develop a specific and detailed legislative text for crimes that fall on parents according to the gravity of the act .
The thesis included two chapters, the first of which dealt with the role of Islamic Sharia and the objective penal policy towards acts that are considered contracts for parents, and the second chapter dealt with the legislative failure to criminalize acts that are considered contracts for parents.
The thesis came out with several recommendations, the most important of which is to reconsider the legislative approach, on the basis of which criminal legislation is adopted and to lay scientific foundations in criminal legislation, suggesting the introduction of a system of moral values when building the legal text, the need for the criminal legislator to take into account the Islamic approach and adhere to it and stay away from every ugly word and deed.
