The college of law at the University of Baghdad discussed a master’s thesis in the private law of the student (Rawa Sabah Naji) and tagged with (Amicus Curiae _ comparative study), on Sunday,17\5\2024 on the model courtroom at the college.
The purpose of the thesis is that the court needs additional knowledge or an independent point of view that will help it make a correct judicial decision by providing legal and factual information and readings.
The thesis contained three chapters, the first chapter dealt with what an amicus curiae is, the second chapter dealt with the scope of recourse to an amicus curiae at the national level, and the third chapter dealt with the scope of recourse to an amicus curiae at the regional and international levels.
The thesis came out with several recommendations, the most important of which is to propose to the Iraqi legislator the adoption by the Amicus Curiae after which a judicial procedure is adopted in the law of proof because of the importance of this procedure through the factual and legal information that he submits to the judiciary, which may affect the verdict. The researcher also proposes to the Iraqi legislator to develop legal texts specifying the specifications to be met in the person intervening as a third party in the case.
