The college of Law, University of Baghdad, discussed the doctoral dissertation in the private law of the student (Shatha Abdul Jabbar Khandan), entitled with (legal regulation of the transport of goods by containers), on Thursday, 28/3/2024 on the conference hall at the college.
The dissertation aims to address the absence of legal regulation of the contract for the carriage of goods by container, its scope is limited to determining the obligations and responsibility of the parties mainly in either unimodal or multimodal transport, in addition to its role in maintaining the safety and security of goods during transportation.
The dissertation included three chapters, the first chapter dealt with the conceptual framework of containerized cargo transportation, the second chapter dealt with the provisions of containerized cargo transportation in the framework of single-mediated transportation, and the third chapter dealt with the legal regime of international multimodal transportation under the use of containers.
The dissertation came up with several recommendations, the most important of which is a recommendation to accelerate the enactment of legislation regulating this type of transport in all its aspects, both with regard to the concept of container and its legal nature, the conclusion of a contract of carriage by container, a recommendation for Iraq’s accession to the Rotterdam Convention and quoting its texts in the new addenda.
