The college of law at the University of Baghdad discussed a master’s thesis in the private law of the student (Zahraa Adel Ibrahim), entitled as (the legal system for holding bare real estate – a comparative study), on Thursday, 2024/03/14 at the conference hall at the college.
The thesis aims to indicate the weaknesses and shortcomings in the Legislative Texts of the Iraqi Civil Law No. 40 of 1951 and to indicate the nature of the contract of naked real estate, which is stipulated by the majority of national and foreign legislations and to find out the obligations of both the lender and the borrower and the effects of one party’s breach of its obligations.
The thesis included three chapters, the first chapter dealt with what a bare estate contract is, the second chapter dealt with the effects of a bare estate contract for contractors, while the third chapter dealt with the effects of a bare estate contract for others and how to end it.
The thesis came out with several recommendations, the most important of which is to propose to the Iraqi legislator to develop a text that addresses the expenses of maintenance and use of the loaned property instead of leaving it to the general rules, and suggested to the Iraqi legislator to develop a text that addresses the case of borrowing several people bare property jointly.
