The Criminal Law at the college of Law, University of Baghdad, held a scientific seminar on published scientific research entitled (criminal mediation as an alternative to the criminal case-a comparative study), in which the lecturer in the Criminal Law (Asst.Lect. Duraid Walid Nazzal) in the presence of a number of the college professors and post-graduate students, on Thursday, 2024/03/07 at the college of Law Building.
The seminar aims to introduce the criminal mediation system and distinguish it from other similar systems, as well as to indicate the position of criminal legislation on it.
The seminar included several topics, including the definition of criminal mediation, the origin of criminal mediation, the position of criminal legislation on it, distinguishing it from similar systems (such as conciliation, reconciliation, and criminal order). As well as distinguishing it from (tribal reconciliation).
The seminar reached several recommendations, the most important of which is to invite the Iraqi legislator to expand the adoption of alternatives to the criminal lawsuit that are applied in deductions that do not require termination through the criminal lawsuit procedures, we hope the legislator to develop a legal system for criminal mediation in which the objective scope is based on taking the descriptive standard in identifying crimes subject to mediation, and that the criminal mediation will result in the termination of the criminal case after the approval of the competent judicial authority-investigation or judgment – according to the circumstances and after ensuring the achievement of the purposes of criminal mediation.
