The college of law at the University of Baghdad discussed a master’s thesis in the international law of the student (Huda Yas Khudair), entitled with (New Plants Variety Protection Under the International Law), on Monday, 2024/02/26 at the conference hall at the college.

The purpose of the thesis is to refer to the most important international conventions and treaties related to the protection and promotion of plants and new varieties, to indicate the position and objectives of both the WIPO and TRIPS conventions with the convention on Biological Diversity, to discuss the nature of the relationship between them and to refer to the role of organizations in the protection of new plant varieties.

The first chapter dealt with the conceptual framework for new plant varieties, the second chapter dealt with the legal framework for the protection of new plant varieties, and the third chapter dealt with the legal mechanisms for the protection of new plant varieties.

The thesis came up with several recommendations, the most important of which is to approve the right of third parties to submit their observations and objections to the protection request aimed at registering the plant variety or the proposed designation of this variety, stipulating that the new plant variety must be withdrawn from circulation and banned this circulation in case of ruling invalid.
