The college of law at the University of Baghdad discussed a master’s thesis in the private law of a student (Sarah Saadoun Aziz), entitled with(the legal system of banks ‘ capital – a comparative study), on Thursday, 2024/02/15 at the conference hall at the college.

The thesis aims that the bank’s capital, being the wall or barrier that prevents any unexpected losses that the bank may be exposed to, and these losses may affect depositors ‘ funds, and that capital plays an important role in maintaining the safety and soundness of the banks and the integrity of banking systems in general .

The thesis included three chapters, the first one dealt with the nature of bank capital, the second chapter dealt with the contribution of bank capital, and the third chapter dealt with the amendment of bank capital .

The thesis came out with several recommendations, the most important of which is recommending the Iraqi legislator to amend the first article of the Iraqi banking law, which defined the bank as (a person holding a license) and amend the definition of the bank as (a company holding a license), recommending the Iraqi legislator to amend Article (28/first paragraph) of the Iraqi companies law, which set the minimum capital of the Joint-Stock Company at two million dinars and the need to raise the minimum because it is a very small amount that does not correspond to the role played by Joint-Stock Companies and their seriousness in the implementation of projects.
