The college of law at the University of Baghdad discussed the doctoral dissertation in the private law of the student (Shamil Ibrahim Majid), entitled with (civil protection of heirs – a comparative study of Islamic jurisprudence), on Thursday, 2024/01/08 at the conference hall at the college.
The dissertation aims to demonstrate the seriousness of the legal and legal effects that affect some heirs, which may lead to depriving them of inheritance, and to raise society’s awareness of the seriousness of the effects on the rights of the heir because of its importance, and in many cases, some heirs may be deprived or removed from the inheritance without right .
The dissertation included three chapters, the first of which dealt with the nature of civil protection of heirs, the second chapter dealt with the basis of civil protection of heirs, and the third chapter dealt with the means of civil protection of heirs .
The dissertation came up with several recommendations, the most important of which was proposed to the Iraqi legislator to include the following text (if the heir acts for any person and retains in any way possession of the eye by which he acted and retains the right to use it for the rest of his life, his act is considered to be added to after death and the provisions of the will apply to him unless there is evidence to the contrary)
