The college of Law, University of Baghdad, discussed the doctoral dissertation in the private law of the student (Fatima Majid Mohammed), entitled with(judicial protection of trade secrets – a comparative study), on Wednesday, 2023/11/22 at the conference hall at the college.
The dissertation aims to address the idea of establishing a specialized jurisdiction in commercial disputes independent of the courts of First Instance, and has a high degree of protection for companies and traders in maintaining their trade secrets, which represent his real capital compared to what he owns in cash and in kind, because maintaining a certain level of commercial success requires mainly maintaining his trade secrets.
The dissertation included three chapters, the first chapter dealt with the nature of trade secrets and distinguishing them from other commercial property, the second chapter dealt with the mechanism of judicial protection from infringement of trade secrets, the third chapter dealt with the scientific application of the protection of judicial trade secrets .
The dissertation came up with several recommendations, the most important of which are the separation of the court of First Instance specialized in commercial cases from the primary court with an independent commercial jurisdiction, the legislation of substantive and procedural law under the title of trade secrets, the use of judicial decisions and precedents of countries that have come a long way regarding the issue of trade secrets.
