The College of Law at the University of Baghdad discussed a master’s thesis in the criminal law of the student (Qassim Muhammad Qassim), entitled with(forcing the witness to attend and testify in the criminal case), on Monday, 20/11/2023 on the model courtroom at the college.
The thesis aims to protect society from crime and reveal the real criminal, as criminal justice is carried out only when there is significant legal evidence, and the testimony is the most important evidence in the criminal case, as it is moral evidence that is almost not without a criminal case.
The thesis also included three chapters, the first dealt with the conceptual framework of testimony, the second chapter dealt with the legal basis for forcing the witness to attend and testify, and the third chapter dealt with the problems and consequences of forcing the witness to attend and testify.
The most important recommendations reached by the thesis suggest amending Article (59 / C) of the Code of Criminal Procedure and adding If the witness is arrested on an official holiday of the guard judge, his arrest to the day of the presence of the investigating judge, and proposed amending the text of Article (1/I) of the law on the protection of witnesses, experts, saboteurs and victims No. 58 of (2017)
