The College of law at the University of Baghdad discussed the doctoral dissertation in the criminal law of the student (Alia Yunus Ali), entitled (abstraction in the lists of criminalization and punishment), on Sunday, 12/11/2023 at the conference hall at the college.
The dissertation aims to explain what the criminal law should be, and the study deals with the topic of abstraction, which is one of the basic topics in law in general and criminal in particular, and aims to open new horizons towards the philosophical study of criminal law topics in terms of returning these topics to their general philosophical origins and the molecules that comprise them.
The dissertation included three chapters, the first one dealt with the rooting of the idea of abstraction in the essence of the Penal rule, the second chapter dealt with the concept of abstraction in the form of rules of criminalization and punishment, and the third chapter dealt with the restrictions on abstraction in the form of rules of criminalization and punishment.
The dissertation came up with several recommendations, the most important of which suggests the need to amend the Penal Code in line with the political and social development that has occurred and the Democratic Change, which requires the cancellation of many texts that contain the ideological psyche and serve the interests of the authority, calls on the Iraqi Penal legislator to keep abreast of the changes brought about by the new social reality and the development that accompanied the scientific and technological revolutions and stipulates restrictions related to the commission of crimes by modern methods that have not been addressed in the special texts.
